So one question we routinely hear from people when they call our office after being arrested for DUI is whether they will lose driver’s license. Well, it depends. So while the case is pending in DC Superior Court you may be able to keep driving if you request a hearing with DMV within 10 days if your license is in DC and 15 days if it is out of State.
So if you plead guilty to DUI or you go to trial and you are found guilty of DUI in DC, yes the District of Columbia Department of Motor Vehicle (DC DMV) will revoke your license. Your license will be suspended/revoked for 6 months if you gave breath, blood or urine score and your license will be suspended/revoked for 1 year if you did not.
It depends. Let me explain. If you enter a Deferred Sentencing Agreement (DSA) you are required to plead guilty and then you get to withdraw your guilty plea in one year. Well, DC DMV rules say that upon a guilty finding you will lose your license even though you are not convicted (conviction requires sentencing). The reason why I say it depends is that sometimes DMV does not know you enter a DSA. For some reason, unlike a conviction, DSA don’t always make it over to DMV. However, assume that it will make it over to DMV.
Usually if you enter a DSA and your driver’s license is not in the District of Columbia, you license should not be suspended or revoked. We can only give you advice in Maryland since we are not licensed in other States. Usually in Maryland your license will not be suspended if you enter a DSA.
Yes, the District of Columbia will revoke your license if you plead guilty to Operating While Impaired (OWI) and you have District of Columbia driver’s license. However, if your license is in Maryland, this usually does not cause revocation or suspension of your license.
If you enter a DSA, you will not lose your license because the other States need a conviction for reciprocity (agreement between the States). If you are found guilty or plead guilty (c0nvicted) you will lose your license because the States follow the National Driver Registry.
