Which Judge hears my traffic case in DC

The cases heard in the Traffic and D.C. Misdemeanor courtrooms are charged prosecuted by the Office of the Attorney General (OAG), rather than by the Office of the United States Attorney (USAO).  There are two types of charges prosecuted by the OAG in the District of Columbia: (1) criminal traffic offenses, (2) District of Columbia Misdemeanors.

Criminal Traffic Offenses:  Criminal traffic offenses include, but are not limited to: driving while intoxicated in DC, driving with a suspended or revoked license, driving and having no valid permit to drive, speed in excess of 30 miles over the speed limit, reckless driving, and leaving after colliding. If you are stopped, and officer is permitted by law to arrest you if he/she has probable cause to believe you have committed a traffic offense in the District of Columbia:

There are other moving violations (ie:failure to obey traffic signal) that are considered civil infractions for which you may not be arrested for.   These matters usually incur points on a license and handled by the Department of Motor Vehicle.

DC Misdemeanors: DC Misdemeanors are non-traffic related offenses including, but not limited to possession of unregistered firmed, unlawful possession of ammunition, drinking in public, disorderly conduct, and possession of an open container of alcohol in public.

Which Judge will hear my Case

The Traffic and Misdemeanor cases that are prosecuted by the District of Columbia are handled by three different Magistrate Judges based upon the District in which the offense occurred or upon the agency you were arrested by.

If Arrested in 1st District, 3rd District or 4th District

If Arrested in 2nd District, 5th District or 6th  District

Your case will be heard at : DC Superior Court, 500 Indiana Avenue, NW Washington, DC 20001

Day of the Week: Tuesday

If Arrested in 7th District or by U.S. Capitol Police or Park Police

Your case will be heard at : DC Superior Court, 500 Indiana Avenue, NW Washington, DC 20001

Courtroom 116;

Judge: Magistrate Judge

 

Time of Day for all Cases

Time: DUI – 9am

Other Traffic Offenses 10 am

Arraignment times for Non-Traffic  Offenses: 11am
