So if you are pulled over for DUI and the officer ask “mam have you have been drinking tonight?”   First and foremost we do not advocate lying to the police officers. You should never do this.   Omission or reserving your right not to speak is not really lying. Remember, if the officer asks you whether you’ve been drinking your answer is admissible in court because you have not been placed under arrest. Therefore your Miranda rights, that is your right to remain silent, anything you say will and can be used against you in a court of lawThe simple way to answer is just be polite and say office if I’ve done something wrong please issue me a citation. However, do not provide the officer any potential evidence for a DUI, DWI charge that can and will be used against you by answering those questions about your alcohol consumption.
